The buyer is the person who is a registered buyer on the account. The buyer must be financially sound in order to do business on the Hespuhús website, www.hespa.is
The following terms and conditions apply to the transaction between the seller and the buyer as well as to the use of the online store hespa.is The terms define the rights and obligations of the seller on the one hand and the buyer on the other. When the special provisions of these terms are omitted, the Act on Consumer Purchases no. 48/2003 and, as the case may be, Act on door-to-door and distance sales contracts no. 46/2000 and law on the purchase of services no. 42/2000.
All information on the website is subject to typographical errors, price changes and stock availability.
Return deadline and right of refund
The return deadline is 30 days, i.e. if the buyer bought the product through hespa.is. he has 30 days to cancel the purchase of a product, provided that he has not used the product, it is returned in good condition and in its original packaging. If a product is sealed, the seal must not be broken. The deadline begins when the product is delivered to the registered recipient. A receipt for the product purchase must be included if a refund is to be made.
Shipping and postage charges are non-refundable. The refund amount shall be the price shown on the order confirmation.
Order
Once the buyer has confirmed the order on the hespa.is website, it is considered binding between the parties. The seller sends the buyer an order confirmation as soon as the order is registered, provided that the buyer has correctly provided his email address. The buyer is encouraged to check separately whether the order confirmation he receives from the seller is in accordance with his order.
Product details
Information about products is presented to the best of the seller’s knowledge at all times. In the presentation of information, the seller makes a reservation about display and/or typing errors in images and text.
If a product is sold out, Hespuhúsið reserves the right to partially or completely cancel the buyer’s order. The buyer is always informed of such decisions and invited to change the order or accept its cancellation.
Price
The seller reserves the right to change the price of a product without notice. That price applies when stated on the buyer’s order confirmation.
The total cost of purchasing a product is stated before the buyer finally confirms the order. It includes all the costs of the order, such as service, shipping fees, etc.
Taxes and fees
All value-added prices in the online store include VAT and invoices are issued with VAT.
Confidentiality
The seller promises the buyer complete confidentiality regarding all information provided by the buyer in connection with the transaction. Information will not be disclosed to third parties under any circumstances.
Payment
The buyer can make a payment with a credit card or with a payment slip at a local bank. When the buyer chooses to pay for the product by credit card, the amount is debited when the product is delivered from Hespuhús’s warehouse. If payment is not received, the seller reserves the right to cancel the order without further notice. If the buyer chooses to pay with a payment slip in a local bank, the goods will be taken away until payment is received by the seller. Products are kept in stock for 3 days due to major holidays. If the transfer is not received within that time, the order will be canceled without further notice.
Delivery of product
The seller strives to deliver the product 3-5 days after the order is received. It is sent by Íslandspóstí unless otherwise agreed.
Receiving goods
Upon receipt of the product, the buyer must check without delay and within a reasonable time limit whether the product is free of defects and in accordance with the order confirmation and product description. The buyer must then check whether there is damage to the product caused by transportation.
The customer has 30 days to make sure that the product is not damaged in transit.
Flaw
If a product is defective or something is missing from the product, the seller is obliged to offer the buyer a new product, a discount or a cancellation of the purchase. It depends on the circumstances which way is chosen in each case.
Notification of defects must be received verbally or in writing.
The seller reserves the right to verify that the product is defective, however within a reasonable time limit.
Warranty
The seller’s responsibility is in accordance with what is stipulated in the law on consumer purchases. Warranty is not established unless order confirmation and purchase receipt is presented.
The seller is not responsible for any damage that may occur to the product in transit. If the product is damaged from the time it is sent from the seller to the buyer, the damage is the responsibility of the buyer.
Personal information
Hespuhúsið handles the buyer’s personal information due to the use of the website saelusapur.is in accordance with the applicable laws and regulations on the handling of personal information at all times.
The buyer undertakes to provide correct information during the purchase, such as address and email address.
Property rights
Product is the property of the seller until the purchase price is paid in full. The seller’s right of ownership remains until full payment has been received, despite the fact that it is an invoice transaction or another form of credit.
Copyright and Trademarks
All content on the Hespuhús website is the property of Hespuhús. All products that appear on this page are subject to the copyright of the designers and the license of the company and may not be copied in any way or used in any other way, according to the law on copyright. The trademark is also registered and may not be used in any way without the permission of the company.
Resolution of doubts
We try to solve all issues in the simplest way possible. If that doesn’t work, there is an option to take the case to the Services and Liquidity Purchase Complaints Committee at the Consumers’ Office. As a last resort, it is possible to take the case to court. The laws and forum of Hespuhús is the District Court of Suðurland.
In general
Hespuhúsið reserves the right to cancel orders, for example due to incorrect price information, and to change the price or stop offering a product or service without notice. If the seller experiences an uncontrollable external event (force majeure), such as an eruption, earthquake, strike or the like, the seller is entitled to postpone his performance or cancel the purchase.
